Staples has a packet called "Prepare a Living Trust" (Adams Legal Forms). Can I use this and has anyone else used this one?

If I want my wife to be on the trust does her name and mine go on the ATF form 1 line 3b, where they ask for "Applicant's name"?
Should line 3 have "The todd ---- and May ---- revocable living trust"? and then I would engrave "TR&MR Trust" (plus city and state)?
And are we both considered Trustees and grantors? Who would then sign the ATF form 1 on line 7 under "Applicant's Signature"?
Any help would be appreciated

As far as the ATF forms, I believe you only need to list one person. As far as engraving, it needs to be easily identifiable etc. so general initial will not work. Your names need to be listed. As far as I know, the only abbreviation that the ATF will allow is to substitute "RLT" for "Revocable Living Trust" in your case.

You do not have to have your name in the trust and just by having your wife's name in the trust name, doesn't make her a trustee. And the applicants name and addy will be the name of your trust and your address.

Why would initials on the rifle not be good enough since I would be carrying the form 1 which on line 4h states any identifying data that is on the rifle and initials would be listed there?
On the form 1 both me and my wife's name will be listed as applicants and that will also be the same for the name of the trust so won't we both be trustees?

Not unless the trust says so.

I've seen enough posts from you in the last few days where stuff doesn't sink in that it's a very, very wise decision for you and your wife to get an attorney in this matter. I don't mean to be insulting or rude, but there's a lot of circular questioning and just not getting things - and that tells me that you'll benefit from counsel in a very real way.

Please, do this right. If the FAQs and forms themselves aren't self-evident, pay the small amount of money to do it right for the sake of the NFA community and your future liberties.

On the Form 1, you and you wife's names should not be listed as applicants if you are going the trust route... The Trust name will be listed.

The Trustees will be defined in the text of the Trust

The Trust name will be engraved on the NFA receiver.

If you want to name your trust the "Bob and Nancy Smith NFA Trust" then you will include that name on the application and in the engraving. That would be the only time that your name would come into play in those two areas.

Your name will be in the Trust document and you will sign as the grantor of the trust on the back of the ATF form.

And if you only engrave your initials on the receiver, then you will be in possession of an illegal firearm.
