No, we will not ship them to NY. The usual restrictions apply.

But they're pre-ban! lol

That seems kind of silly (no offense, I find you to be an excellent reputable seller)!

All the people in the states with limitations like NY would love to buy them since that's the only legal way to be in good graces with the law. Everyone else can just go buy non pre-ban magazines to keep John E. Law off their back.

I don't get it either, living in the slave state of MA I run into this all the time. By not legally selling into pre-ban states dealers like this are just letting the gun grabbers win.

Try to find some old std capacity mags on gunbroker (you can tell pre-ban by the markings) and have them shipped to an FFL in your area if they balk at shipping to NY. I just did this and got 3 pre-ban 229 mags for $75. Much better than the $75 apiece I was offered on this forum.

Section 131M. No person shall sell, offer for sale, transfer or possess an assault weapon or a large capacity feeding device that was not otherwise lawfully possessed on September 13, 1994. Whoever not being licensed under the provisions of section 122 violates the provisions of this section shall be punished, for a first offense, by a fine of not less than $1,000 nor more than $10,000 or by imprisonment for not less than one year nor more than ten years, or by both such fine and imprisonment, and for a second offense, by a fine of not less than $5,000 nor more than $15,000 or by imprisonment for not less than five years nor more than 15 years, or by both such fine and imprisonment

I am not an Attorney and I am not going to take a guess as to whether or not my company would be in violation of your State laws by shipping a large capacity feeding device to you that you did not lawfully possess prior to 1994. If you want to take the chance, we will be more than happy to ship standard capacity magazines to another State for you, but I do not want one of our invoices to show a restricted State as the shipping address.

Are these laws clear and enforceable? Probably not, but I damn sure do not want to become a test case for an overzealous Attorney General.

I hear ya Tom. Nobody wants issues and I don't blame you, it's not worth it.

For what it's worth the laws for NY are worded differently

quote:
Definition
23. "Large capacity ammunition feeding device" means a magazine, belt, drum, feed strip, or similar device, manufactured after September thirteenth, nineteen hundred ninety-four, that has a capacity of, or that can be readily restored or converted to accept, more than ten rounds of ammunition; provided, however, that such term does not include an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

quote:
Penal code 265.02
§ 265.02 Criminal possession of a weapon in the third degree.
A person is guilty of criminal possession of a weapon in the third
degree when:
(1) Such person commits the crime of criminal possession of a weapon in the fourth degree as defined in subdivision one, two, three or five
of section 265.01, and has been previously convicted of any crime; or
(2) Such person possesses any explosive or incendiary bomb, bombshell, firearm silencer, machine-gun or any other firearm or weapon simulating
a machine-gun and which is adaptable for such use; or
(3) Such person knowingly possesses a machine-gun, firearm, rifle or shotgun which has been defaced for the purpose of concealment or prevention of the detection of a crime or misrepresenting the identity of such machine-gun, firearm, rifle or shotgun; or
(5) (i) Such person possesses three or more firearms; or (ii) such person possesses a firearm and has been previously convicted of a felony or a class A misdemeanor defined in this chapter within the five years immediately preceding the commission of the offense and such possession did not take place in the person's home or place of business; or
(6) Such person knowingly possesses any disguised gun; or
(7) Such person possesses an assault weapon; or
(8) Such person possesses a large capacity ammunition feeding device.
Criminal possession of a weapon in the third degree is a class D felony.

Slightly off topic, but since they exclude .22LR ammunition, I wonder if that means purchasing a GSG-5 with it's 22 round magazine is a-ok. Going to post this in the Laws forum ;-D

In Ma pre ban mags are allowed, as long as the buyer has a class A LTC. Most gun shops in Ma sell pre-ban Hi caps, but at extemely inflated prices.

Buy these while they last! I just got mine in the mail Monday & if they are 'reconditioned' you can't tell... they look newer than my new ones and function flawlessly.
Thanks again Tom.

I would have no problem relying on these for defensive purposes. Other than the magazine tube, they are brand new factory magazines.

All parts are SIG factory parts. The follower, spring and insert are original (brand new) JP Sauer & Sohn German parts and the base plates are current production Mec-Gar Italian.
