The U.S. Supreme Court declined to take up a challenge to President Donald Trump’s border wall Monday, which asserted that the administration violated the Constitution when it exempted border barrier projects from environmental regulations.

The plaintiffs warn of adverse effects to local ecosystems should the administration raise a wall along the border with Mexico.

“It’s disappointing that the Supreme Court won’t consider this important constitutional issue,” Brian Segee, a senior attorney at the Center for Biological Diversity (CBD), told The Daily Caller News Foundation by email. “Trump has abused his power to wreak havoc along the border to score political points. He’s illegally sweeping aside bedrock environmental and public health laws. We’ll continue to fight Trump’s dangerous wall in the courts and in Congress.”

A 1996 law authorized the attorney general (and later the Homeland Security secretary) to build border barriers to deter illegal immigration. In that connection, the law gave the Department of Homeland Security secretary power to exempt certain border projects from environmental laws like the Endangered Species Act, as well as other legal rules, to ensure quick construction.

The law also restricts the jurisdiction of courts to hear legal challenges to the secretary’s waivers, and provides that such lawsuits must be lodged on an accelerated timetable.

A coalition of green advocacy groups sued after the Trump administration issued two waivers under the ’96 law for border wall projects in southern California. The plaintiffs argued the waiver and jurisdictional provisions violate the constitutional separation of powers.

“[The ’96 law] effectively allows an unelected cabinet secretary to repeal existing laws, and then shields the repeals from judicial review,” the CBD’s petition to the high court reads. The petition urged the justices to curtail the “extraordinary conferral of waiver authority that fundamentally distorts the allocation of power in our tripartite system of government.”

U.S. District Court Judge Gonzalo Curiel sided with the federal government at an earlier stage of the case, prompting the appeal to the Supreme Court.

The president has clashed with Curiel in the past, as Curiel presided over a civil suit against Trump University, a real estate training program that has since closed.

2020 aspirant Robert “Beto” O’Rourke is among the signatories to an amicus (or “friend of the court”) brief from Democratic lawmakers urging the justices to hear the case.

Trump has made funding for the border wall a priority during the lame duck Congress, threatening to shut down the government if the project is not funded in full by year’s end.

“We need border security in this country, and if that means a shutdown I would totally be willing to shut it down,” Trump said on Nov. 28. “And I think it’s a really bad issue for the Democrats.”

I am so embarrassed that this critter is from Texas (and almost defeated Ted Cruz). I am not a Native Texan, but I got here as soon as I could (38 years ago) and Beto does not represent the Texas I know and love.

The fate of The Weekly Standard, the conservative magazine that has staked out a position as a publication on the right still critical of President Donald Trump, is uncertain, Editor-in-Chief Stephen Hayes told staff in a series of phone calls Tuesday, according to two people familiar with the matter.

The magazine's precarious position comes after its leadership spent months searching for a buyer, the people told CNN.

The people explained that The Weekly Standard's leadership had butted heads with MediaDC, the current publisher of the magazine, and that the two parties had agreed to allow Hayes to search for a new owner.

However, MediaDC recently informed The Weekly Standard's leadership that the company was no longer interested in a sale, the people said.

Instead, Ryan McKibben, the chairman of MediaDC, asked to meet with Hayes in a meeting tentatively scheduled for late next week, the people said. McKibben, they said, also requested the entire staff of The Weekly Standard be made available following the meeting.

Employees at the magazine are bracing for the worst, multiple people familiar with the matter told CNN.

I want to be honest with everyone. I absolutely hated Trump until 3:00 AM on November 9, 2016 when it became apparent that not only did Trump win the election, but the House and Senate were still safely in Republican control. It was at that point that I became a rabid Trump fan.

You just can't argue with success like that.

I've been more impressed with Trump's second year than his first and I was damn impressed with his first year.

I expect the next two years to be even better. Trump does best when he has a target to aim at and the Democrats just handed him one in the form of Pelosi.

As an aside, has anyone else noticed that when Republican leadership screws up they are gone, but the Democrats keep pulling out the same tired faces expecting something different?

I am reading this morning that the MSM is making a big deal out of Trump not reciting the Apostles Creed at the Bush funeral.

I have noticed a trend in the MSM lately attempting to use Christianity against Christians.
That is so 2 faced of some to lecture Christians about their faith when these media types are non believers and or cafeteria Christians.. Argh!

I don't recite that creed either because I am an Apostolic Pentecostal type who believes in the One God, not the Trinity and besides, I'm not Catholic.

I guess the MSM might not know such as they pretend to be somehow be experts on Christianity.
Not all Christians recite that creed.

Some Baptist congregations don't recite any Creed at all, and most Pentecostals don't. I doubt that Unitarians do, either (at least not one referring to a Triune God).
