Well, the key here will be to see what "illegally owned" means. If it's a violation of something stupid like a magazine restriction, then this could be an interesting test of bullshit laws. On the other hand, if he's a felon in possession, he's could be screwed.

The article said felony possession of an illegal handgun. Doesn’t look like he was a felon. He more than likely was in possession of a New York restricted hand gun or it was unregistered or he didn’t have a state permit to own one. You couldn’t pay me to live in that state. Georgia doesn’t even have state registration of firearms.

Hopefully he draws a good jury and beats the criminal charges. The real danger he faces is from whatever family these turds have; if they’re cut from the same kind of cloth, they might be thinking civil suit. Then the jury has to be at least 50% in his favor.

This. Unfortunately, he probably wasn't following his state's stupid laws. I know all about that obviously. If you're going to live in states with stupid laws, best to follow them. I see a lot of people with the mentality of "no one's going to find out, fuck those dumb laws." This guy might have had that mentality...

Perhaps he was merely accurately assessing his chances of being 64 years old and potentially facing multiple opponents. As it turned out he did in this case, which included a male less than half his age.

He may have felt that his life was worth more than any punishment which the State of New York could mete out to him for illegal possession of a firearm.

But regardless he's still alive. There's a saying, "Better to be tried by 12 than carried by 6."

Oneida County is way out in the sticks. Most of those counties are Shall Issue for carry permits so he could easily have had one, if not a felon. If he had a permit and just somehow got his hands on a handgun and didn't register it, he will be totally fine. Unregistered firearm possessed by a permit holder is like jaywalking.

However, you are not allowed to even handle a handgun *in a gun store* without a valid permit. If he has no permit, he will likely be charged and convicted. Handguns are so verboten and the prohibition is so commonly known that jury nullification will not be an option. It would be easy to get 12 people to say "Yup, no hanguns without a permit. Everybody knows that" and find him guilty.

His only hope is that the DA defers prosecution because it was a good shoot and he feels sorry for him and about the civil suits to come.

Oh, okay. It was Utica. But still most of the gun laws are at the state level. The judges up there MIGHT be more lenient, but the laws may not give them too much leeway.
