Yet the story you linked to didn't address the most important aspect of this bill....are there penalties if Florida politicos ignore the law, and if so, what are they? Without severe penalties, I can see a number of Florida cities simply ignoring this law all together and doing as they please. That's the only reason firearm preemption laws in Florida work, because the penalties for violating them are severe enough to force compliance.

Here is the enforcement piece of the new law. It does not provide a criminal penalty but gives the Governor a big hammer.

908.107 Enforcement.— 241
(1) Any executive or administrative state, county, or 242
municipal officer who violates his or her duties under this 243
chapter may be subject to action by the Governor in the exercise 244
of his or her authority under the State Constitution and state 245
law. Pursuant to s. 1(b), Art. IV of the State Constitution, the 246
Governor may initiate judicial proceedings in the name of the 247
state against such officers to enforce compliance with any duty 248
under this chapter or restrain any unauthorized act contrary to 249
this chapter. 250
(2) In addition, the Attorney General may file suit against 251
a local governmental entity or local law enforcement agency in a 252
court of competent jurisdiction for declaratory or injunctive 253
relief for a violation of this chapter. 254
(3) If a local governmental entity or local law enforcement 255
agency violates this chapter, the court must enjoin the unlawful 256
sanctuary policy. The court has continuing jurisdiction over the 257
parties and subject matter and may enforce its orders with the 258
initiation of contempt proceedings as provided by law. 259
(4) An order approving a consent decree or granting an 260
injunction must include written findings of fact that describe 261

And once again, not good enough. If Florida happens to elect a Dem governor and/or AG at some point, that person(s) can all but thwart this entire statute. Compare and contrast the penalties in Florida's firearm preemption law....

790.33(3) provides:

[a]ny person . . . that violates the Legislature’s occupation of the whole field of regulation of firearms and ammunition . . . by enacting or causing to be enforced any local ordinance or administrative rule or regulation impinging upon such exclusive occupation of the field shall be liable.1

Specifically, a local official who knowingly and willfully violates the statute shall be fined up to $5,000;2 may not be indemnified for the costs of defending himself or herself;3 and may be removed from office by the governor.4 Florida’s law was the first in the nation to provide that a local legislator can be held financially liable and removed from office for “enacting or causing to be enforced” a local ordinance that impinges upon the field of firearms regulation.

That's the way to handle garbage politicians who think they and their agenda are above the law.

It's about time we had a governor who actually does something he campaigned about. I am glad we have a guy who has a good background as well, someone to be respected.
