Penagos-Clare was booked into the Multnomah County Detention Center and charged with:
    Robbery in the first degree
    Assault in the second degree
    Unauthorized use of a motor vehicle
    Failure to perform the duties of a driver-injury, which is a C Felony

The two truck driver was hit hard in the head, he could have faired much worse.

I'm surprised the tow truck driver got back up. Hope he doesn't have any serious injuries.

That driver has no place in society. Just lock them up for the next 50 years.

Well I wouldn’t be surprised if the tow driver had stolen her truck anyhow. My experience with tow companies has been that they are thieves. I’ve had 2 cars basically stolen by tow companies and had to pay their ransom to get my vehicle. Okay maybe I’m just bitter.

I used to own a tow truck company. The city did not have their own trucks so vehicles that needed to be towed were done by private companies authorized by the city (about 20 of us that took a rotation position). Rules were very strict about what we could or could not do. Required expenses and insurance was off the charts. (think about it, who's rights are being infringed...the car owner that is a schmuck or the property owner that just wants to use their property). Yes, I was called every vile name you can imagine.

Car owners periodically called the law on me to have me "arrested" for car theft however, we had a long and expensive consultation with my attorney before I even opened the business. I always got authorization (signed on a hard copy) and made sure I was well, let me repeat well within the law. I always loved it when some @#$% came up to me and threaten me. I just quietly called the law. Officer told the car owner how things were. "You are busted for being an as___le" pay the man and shut up. Sometimes they were carried away in handcuffs when they enthusiastically disagreed with the officer.

Listen guys, this is a job. Sometimes it is not pleasant for us either. We don't like towing away cars but you did something for us to be called. I didn't unilaterally pick up your car just be a schmuck. We are called out by a property owner, business owner or law enforcement and we operate within the law. In the 12 yrs I was in the business I was never sued, nor arrested for "car theft" but lots of car owners were carried off in cuffs.

One more thing...I had cars stolen from my lot a twice. In both cases, the car owner was arrested for breaking and entering as well as vandalizing private property. These are felonies where I lived.

From what I saw in this video, I am pretty sure the driver has a cause of action against the driver as well. Criminal as well as civil. Maybe one of our LEO's or attorney's could comment on what that would look like.

T-Boy, I'm sure there are honest tow drivers out there. But I had my car stolen by them twice.

First time, girlfriends condo in a snowstorm. Move the car, plows come through. Park car again. 2 hours later plows come by again, followed by tow driver. I go out and speak to plow and ask if he wants me to move again. Nope, my spot is good, no problem. I tell tow drive and plow driver gives him thumbs up from his truck. Tow driver says no problem. I go in the house. 30 minutes later my car is gone. $190 to get back. I'd have loved to drive my car into him just like that lady did but I'm not a criminal. Guy was an asshole.

Next time parked in visitor spot at apartment complex. Tow driver shows up and starts hooking up my car. I happen to look out and run down. Big fat asshole refuses to unhook my car. I call cops, take pictures and he drives off. That was about $300. Cops were no help. I could have gone to small claims but not worth the time and aggravation.

So while there are likely honest tow guys my experience was with criminals.

Why is a hit like that on the tow driver not considered attempted murder? Is the assault 2nd degree something that may be upgraded later?

I had a maintenance man who had worked as a repo man before coming to work for us. I have no idea why the owner hired him. One of the lowest forms of human life. Yeah, he carried concealed, but no license.

First two I agree with and are the charges that were brought against the ones that pulled this stunt at my storage yard. The last one, my attorney told me, you cannot charge because you cannot "steal" your own property.

After a few years, I managed to secure a storage facility off site from my main business. I never revealed my storage facility address till after the bill was paid in full. Then we would drive out the storage lot and pick up the car. No problems after that. They still verbally abused me however.

Not exactly true that you can’t steal your own property.
There are occasions where the property is being held as collateral (which is exactly what happens with a tow yard and other instances like a pawn shop).

But also nowhere in the article does that say it is actually her car or even that it was not repossessed.

More to the story as no one with that nice of a truck is going to go through all that to get their truck back from a parking violation tow.

It would be interesting to know why they did this. She did an awful lot of damage and got in a whole lot of trouble... why? It couldn't be just to avoid the cost of the tow.

Possibly. I mean, what good is it to avoid a $300 impound fee if you have to pay $1000+ in repair costs?

Of course, that is assuming the driver is a rational, sensible person. . .

My guess is her Grand-Dads truck was towed...

He tells his grand daughter and she is a whack-a-do and gets all "Millenial pissed off" and shit...

Tells Grand-dad she'll help him stick it to the man and free Willy (his truck).

They get there and try to cut the lock but Grand-dad gets cold feet.

Whack-a-do tells him "here, hold my beer and watch this!"
