Gardner alleges racist conspiracy in federal civil rights lawsuit against St. Louis, police union


ST. LOUIS — The first black woman elected as circuit attorney in the city of St. Louis is taking long-standing racial tensions, specifically between her office and the police department, to federal court.

On Monday, Circuit Attorney Kimberly M. Gardner filed a federal civil rights lawsuit alleging a racist conspiracy to stop her from doing her job. Gardner is suing the city of St. Louis; the St. Louis Police Officers Association and its longtime business manager Jeff Roorda; a former police officer named Charles Lane who sued Gardner’s office; and Gerard Carmody and his children, who are the private attorneys appointed as special prosecutors to investigate her office’s handling of the investigation of former Gov. Eric Greitens.

“Gardner was elected in 2016 on a promise to redress the scourge of historical inequality and rebuild trust in the criminal justice system among communities of color,” says the lawsuit, filed on Gardner’s behalf by three outside law firms from St. Louis, Washington and New York. “Unfortunately, entrenched interests in St. Louis, including Defendants, have mobilized to thwart these efforts through a broad campaign of collusive conduct, including the unprecedented appointment of a white, ethically conflicted Special Prosecutor to investigate the activities of Gardner’s office and a patently overbroad and unconstitutional ransacking of the office’s electronic files.”


Gardner alleges the SLPOA and its officers are at the core of a conspiracy to “thwart and impede her efforts to establish equal treatment under law for all St. Louis citizens.” She cites the 1871 Ku Klux Klan Act, also known as the Civil Rights Act of 1871, to allege violations of her Fourth and 14th Amendment rights.

“The Ku Klux Klan Act was adopted to address precisely this scenario: a racially-motivated conspiracy to deny the civil rights of racial minorities by obstructing a government official’s efforts to ensure equal justice under law for all,” the lawsuit alleges. “The stakes are high. This case cries out for federal enforcement.”

In a statement, Jacob Long, spokesman for St. Louis Mayor Lyda Krewson, called Gardner’s lawsuit “meritless” and said the “city fully expects to be vindicated.”

The SLPOA, in a statement not attributed to any specific official, called the lawsuit “frivolous and without merit.” The statement said Gardner’s lawsuit was a “frantic ploy” to deflect from problems in her office.

Roorda did not return phone calls seeking comment. Lane said he hadn’t seen the lawsuit. Carmody did not return a phone call or email seeking comment.

Gardner says the lawsuit is not an attempt to block Carmody’s prosecution of her former investigator, William Tisaby, who has been charged with perjury in the since-dropped investigation of Greitens over his alleged threat to disseminate a photo he took of a partly nude woman without her permission. Gardner’s lawsuit was filed the same day another of Gardner’s former investigators, Anthony Box, was scheduled to be deposed in that investigation. Gardner’s office has been blocked by a judge from participating in the deposition.



The lawsuit, Gardner said in an interview, “is going to set the tone that the people of St. Louis are not going to allow a select few to stop criminal justice reform. We will reform the system.”

Gardner is part of a national trend of “progressive” prosecutors — many of them black — who campaigned on a platform of making the criminal justice system more fair and equitable for all citizens. Their efforts have included increasing diversion programs, holding police accountable, reducing jail populations and starting Conviction Integrity Units to investigate old cases for possible mistakes.

To date, local courts have blocked Gardner’s attempt to overturn the murder conviction of Lamar Johnson, in which she alleges prosecutorial misconduct and lies by police detectives in obtaining a fraudulent conviction. That case is now before the Missouri Supreme Court.

Gardner’s federal lawsuit is being financed by the legal advocacy fund of a Dallas-based nonprofit called Mothers Against Police Brutality. The organization was founded by Collette Flanagan, a former IBM executive whose son, Clinton Allen, was shot and killed by Dallas police in March 2013. Allen was unarmed.



In nearly every city where a progressive prosecutor has won an election, the local police association has opposed his or her efforts.

But what is happening in St. Louis is unique, says Roy Austin, one of Gardner’s attorneys.

“What we are seeing here is a unique set of circumstances,” Austin said. “We can have a debate on policy. That’s a fair and righteous fight to have. But they are personally trying to destroy Kim. I don’t know of another case in the nation where they have taken all of the prosecutor’s files and handed them over to the police department without any constraints whatsoever.”

In the case against Tisaby, Carmody, the special prosecutor, sought Gardner’s files as part of his investigation. Gardner opposed the request in court but a judge ruled in favor of Carmody.

Austin says the federal lawsuit is not an attempt to “interfere” with Carmody’s criminal investigation.

The lawsuit goes to great lengths to outline what Gardner and her attorneys call a “History of Invidious Racial Animus Within the City, Its Police Division, and the SLPOA,” including detailed descriptions of social media posts by multiple white police officers, many of which were outed by the Plain View Project in 2019. Few of the officers involved in those posts have been disciplined, Gardner’s lawsuit says.



The lawsuit cites the federal prosecution of several St. Louis police officers over the violent beating of black, undercover officer Luther Hall after protests that followed the acquittal of white police officer Jason Stockley in the shooting death of Anthony Lamar Smith.

“The resistance to Gardner’s efforts to improve investigations of police misconduct in St. Louis included threats by Defendants Roorda and SLPOA to reduce protection for members of the City’s Board of Aldermen if they supported Gardner’s proposals,” the lawsuit alleges. “The SLPOA, Roorda, and the Police Division have continued to oppose Gardner’s reform efforts at every turn.”

The lawsuit has interesting timing. It was filed the day before several black, female, progressive prosecutors from around the country are scheduled to meet in St. Louis in support of Gardner.

“This is not about Kim Gardner running for office,” Gardner said, when asked about the timing. “This is about making sure reform-minded prosecutors are able to do their job without fear or retaliation.”

Let me try to explain this so that even Ms. Gardner can understand it. People obey the law for one of two reasons. One may be that they have been taught by family members (hopefully parents), school employees, church attendance or other mentors that it is the right thing to do. The other possibility is that they are afraid if they get caught breaking the law there will be serious consequences that they will not like. If number one never occurs and you remove number two, what stops criminals? I truly feel sorry for our wonderful men and women in law enforcement who have to work with someone who doesn't understand this simple concept.

The overwhelming reaction from the area is: Kim Gardner is a dumbass. If this goes to trail there will miles long lines of witnesses testifying that Gardner is a dumbass and is now hiding behind "they are mean to me because I am black" because her whole progressive justice bullshit is not working. The St. Louis City prosecuting Attorney's Officer lost almost 500 years of trial experience due to her getting rid of prosecutors.

The main rumor for her lawsuit is that she is going to be indicted due to the Tisaby case and she is trying to get in front of it defect blame and fallout. I hope she bankrupts the bullshit Dallas group financing her lawsuit lawyers....but that is Soros money anyway.

The family said they want "answers and compensation". It seems they have ignored answers which include the facts that prior to going lethal, the decedent was tased twice without success and additionally, he was found to have had PCP in his system at the time of the incident. Luckily, the jury realized that this was about a big payday and denied it.

You know the old saying about the best defense being a good offense. As far as Soros money goes, I was totally unsurprised when Gardner was elected in the city and less surprised when the Soros connection was revealed. In the one-party city, that is to be expected. The interesting thing is that Soros' financial support appears to be continuing well after the election as evidenced by the support she's receiving from the Dallas group.

The county was another story. I was truly shocked when county voters kicked McCulloch to the curb in favor of the current Soros-backed office holder whose views and allegiances seem closely linked to those of Gardner.

That was because during the Dims primary, all the Claire McCackle Dim supporters (the same ones who would have voted for McCulloch were voting in the Republican primary to influence who Claire had to run against, same thing she did in her previous election. With the Soros money and social media influence, McCulloch didn't stand a chance. Now the next election will be very interesting for Wesley Bell in St. Louis County; just the not going for the death penalty in both the Catholic Supply Store Killing and the execution of the North County Co-Op Police Officer will probably cost him the election. Several good people running against Bell in the primary and the Republicans may run someone.

And now something new from the lying Cocksucker known as the St. Louis City Prosecutor. She was stopped for driving without her headlights on, initially said she was held and intimidated during a 30 minute traffic stop but then changed it to a 15 minute traffic stop (after the police department told her it was less than 15 minutes per the Racial profiling traffic stop data that has to be submitted with every traffic stop). She had an investigator show up to try and interfere with the stop. Luckily there was an area surveillance camera that caught the incident, 6 minutes and 15 seconds from start to finish.

I wonder when the left will flip on camera usage, claiming "personal privacy" or some such nonsense? Probably when a really big leftist fish gets hemmed up.

That is almost a plausible explanation if it were some random citizen not familiar with or working in the legal system. However, she is the Circuit Attorney for the city of St. Louis, albeit one who has been at war with the city police department since her election and who has become well known locally for couching criminal coddling in terms of criminal justice reform. Then there's the fact that she claimed the stop was on Dec. 24th when it was on Dec. 23rd. Again, many people could be off by a day but when one of the days in question is Christmas Eve, it would appear less likely to be an honest mistake and more likely a tactic to get yet more misinformation out into the media attacking the police and furthering support for her civil rights lawsuit against their union.

Here's another video where she smugly and arrogantly claims that it was all part of intimidation tactics aimed at stopping reform. Another interesting part of the video shows a statement from the Ethical Society of Police, a union representing black officers. The statement cites the surveillance video which clearly shows that Gardner was driving without headlights and that the stop lasted some 6 minutes and occurred on Dec. 23 according to records and calls for her to be accountable and factual about her actions.

One of the local TV stations crunched some numbers and the results aren't favorable for Gardner. They show a city with one of the highest violent crime rates in the country with one of the lowest conviction rates. She was invited to give a response to this story and declined.

True to form, Gardner only gives interviews when they are in her interests such as when she announced her federal civil rights lawsuit and when she (largely erroneously) detailed the 'racist' treatment she claimed to be a victim of when she was stopped for driving after nightfall with no headlights.

The Soros connection is an insidious problem which will only grow with time. Every year, the number of contributions he makes and and dollar amounts contributed seem to rise significantly.

The real problem will be when like-minded politicians begin to appoint Soros-backed prosecutors to the judiciary.

Why are wealthy left-wing donors across the country, the abortion industry and national gun-control groups more interested in your local school board and city council races than most of the people who live in your own town?

Because they’re funding efforts to ensure their far-left agenda pervades our entire society — from getting their abortion curricula into our schools to changing our election laws — and they want to make sure that no city, no town is left to stand against them.

National left-wing organizations are collecting and funneling hundreds of millions of dollars to flip local city councils, school boards and county prosecutors’ offices to the left. They are flooding small elections with big money, and it’s giving them unprecedented influence over our local affairs and greater access to our children.

We’re witnessing the election of leftist local prosecutors who are refusing to prosecute whole classes of crimes. Rather than working with their state legislatures or city councils to reform the criminal justice system the right way, they are choosing to ignore the laws they took oaths to uphold and are single-handedly nullifying laws they don’t like.

Prosecutors who promise leniency have won races across the country, including in Philadelphia and Chicago, cities with two of the highest crime rates in the nation. Their campaigns have been supported by wealthy out-of-state billionaires, one of whom spent millions just last November backing candidates in several Virginia counties.

It’s not only prosecutors’ offices, though. In one example, community organizers from national organizations descended on one county in Tennessee to take over the school board and county commission. They ran left-wing candidates for the school board and gained control of the school curriculum. Newsweek reported on one teacher training session that included a talk on “white privilege” that asserted, “Even when minorities express or practice prejudice against whites, they are not racists.”

National abortion groups have donated millions to elect state and local candidates who vow to weaken abortion laws and give the abortion industry access to our schools. Those groups use their influence to get officials to adopt their sex education curriculum in local schools. One group has even created high school “clubs” where it trains students in abortion activism.

Another part of the takeover agenda is gun control. In last fall’s Virginia elections, one anti-Second Amendment group spent $2.5 million to elect gun-control advocates to the Virginia General Assembly. It was the largest out-of-state spender in Virginia’s elections, and its candidates have helped push the unprecedented gun-control legislation we’re now seeing.

These far-left groups aren’t going to stop, and they have the money and the people on the ground to insert themselves in communities across the country. Fighting them is going to require local citizens working together, and national organizations like The Heritage Foundation and others working to expose them.

We’ve all heard the story when, as he was leaving the Constitutional Convention, Benjamin Franklin was asked whether America had ended up with a republic or a monarchy. He replied, “A republic — if you can keep it.” The same character and sacrifice that were required to found this republic are now desperately needed to keep her.

Our Founders pledged their lives, their fortunes and their sacred honor to the cause of a free nation. We must do the same. Fortunately, we don’t have to die for this cause, but we do have to give our lives in the sense that we must dedicate our time and a portion of our treasure to defending this nation — community by community — against those who would destroy it from within.

That means calling and writing your elected officials about proposed legislation, attending city council and school board meetings to prevent them from adopting these agendas, and volunteering for and giving money to candidates who will forward limited government, free market principles and traditional American values. Then we must multiply our voices by getting 10 of our like-minded friends registered to vote and to turn out on Election Day.

Conservatives must do more than complain. We must be willing to stand up and fight. We must engage in the battle, otherwise, we will cede the battlefield and, ultimately, our country.

I don’t want to leave my children and my grandchildren an America that’s less free than the one I inherited. Protecting our hard-fought American way of life is one of the greatest gifts we can pass on to the next generation.
