Another of President Trump's nominees to the San Francisco-based 9th Circuit Court of Appeals cleared a key procedural hurdle in the Senate on Monday, as the White House continues its push to transform the key left-leaning appellate court that the president repeatedly has derided as hopelessly biased and "disgraceful."

By a 77-20 vote, the Senate invoked cloture to end debate on Trump's nomination of Arizona-based Magistrate Judge Bridget Bade, a former clerk to conservative 5th Circuit Judge Edith Jones. Bade is slated to replace Bill Clinton-nominated Judge Barry Silverman, who has been on senior status since late 2016 -- effectively judicial semi-retirement.


Bade was one of 51 judicial nominees the White House renominated earlier this year after the Senate failed to take action on them during the previous congressional session. Still waiting in the wings were Trump's other conservative 9th Circuit nominees: Daniel P. Collins, a former clerk to the late Justice Antonin Scalia; Daniel A. Bress, also a former Scalia clerk; and former George W. Bush administration official Kenneth Lee. All are currently in private practice.

Monday's vote all but assures Bade's confirmation this week after she was cleared out of the Judiciary Committee by a 17-5 bipartisan vote in February. Democrat Sens. Dianne Feinstein, Patrick Leahy, Dick Durbin, Sheldon Whitehouse and Chris Coons joined Republicans to support Bade in the committee, while Democrat presidential contenders Amy Klobuchar, Corey Booker, and Kamala Harris sided with Richard Blumenthal and Mazie Hirono to reject Bade.

Justice Department sides with court ruling Obamacare invalid

The Department of Justice on Monday announced that it is siding with a district court ruling that found the Affordable Care Act unconstitutional.

The move is an escalation of the Trump administration's legal battle against the health care law.

The DOJ previously argued in court that the law's pre-existing condition protections should be struck down. Now, the administration argues the entire law should be invalidated.

U.S. District Court Judge Reed O'Connor ruled in December that the Affordable Care Act's individual mandate is unconstitutional, and that therefore the rest of law is invalid.

The DOJ said Monday that it agrees that decision should stand, as the case now works its way through the appeal process in the Fifth Circuit Court of Appeals.

"The Department of Justice has determined that the district court’s judgement should be affirmed," the department said in a short letter to the U.S. Court of Appeals for the Fifth Circuit.

The move is certain to prompt new denunciations from Democrats, who had already seized on the Trump administration's earlier call for the pre-existing condition protections to be struck down.

That stance was a major issue in last year's midterm elections, and many Republican candidates in tough races struggled with whether to say they agreed with the Trump administration's position.

Many legal experts in both parties think that the lawsuit, which was brought by 20 GOP-led states, will not ultimately succeed. The lower court judge who ruled against the law in December is known as a staunch conservative.

The case centers on the argument that after Congress repealed the tax penalty in the law's mandate for everyone to have insurance in 2017, that the mandate can no longer be ruled to be constitutional under Congress's power to tax. The challengers then argue that all of ObamaCare should be invalidated because the mandate is unconstitutional.

Most legal experts say that legal precedent shows that even if the mandate is ruled unconstitutional, the rest of ObamaCare should remain unharmed, as that is what Congress voted to do in the 2017 tax law that repealed the mandate's penalty.

Hannity gets a bit overwrought, but you could see that he and Tucker are both committed to getting the real story out-- a story of would-be totalitarians attempting a takeover of our country-- and exposing those who were behind the attempted coup. It's not just about ratings. They clearly know that our country is in jeopardy, and that the chips are down. This is a historic crisis, unlike anything since the Civil War.
